Terms of Service

By accessing or using TrustChain AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including organizations accessing the Service via API.

TrustChain AI provides an AI compliance middleware platform that: (a) proxies requests between your applications and LLM providers (OpenAI, Anthropic, Google); (b) scans prompts and responses for PII, security threats, and policy violations; (c) generates audit logs and compliance reports; and (d) provides incident management and usage analytics.

You must create an account to use the Service. You are responsible for: (a) providing accurate registration information; (b) maintaining the confidentiality of your credentials; (c) all activity under your account; and (d) notifying us immediately of unauthorized access at security@trustchain.ai.

You agree NOT to use the Service to: (a) process requests containing malware, exploits, or code designed to harm systems; (b) circumvent our compliance engine or tamper with audit logs; (c) resell or sublicense access to the proxy without written permission; (d) violate applicable laws, including those governing data protection; (e) transmit content that is illegal, harmful, or infringes third-party rights; (f) use the Service to train competing AI compliance models without our written consent.

API keys issued by TrustChain AI are your responsibility. You must: (a) store keys securely and never commit them to source control; (b) rotate keys immediately if you suspect compromise; (c) use separate keys per environment (development, staging, production); (d) not share keys across organizations. We may revoke keys that violate these Terms without notice.

Your use of the Service is governed by our Privacy Policy. You represent that you have the right to submit data processed through TrustChain AI, and that doing so does not violate any third-party rights. You remain the data controller for end-user data; TrustChain AI acts as a data processor.

We target 99.9% uptime for the proxy endpoint. Planned maintenance will be announced 24 hours in advance. We are not liable for downtime of third-party LLM providers (OpenAI, Anthropic, Google). SLAs for Enterprise customers are defined in separate agreements.

TrustChain AI retains all rights to the platform, compliance rules engine, brand assets, and documentation. You retain all rights to your own data. By using the Service, you grant us a limited license to process your data solely to provide the Service.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT: (a) THE SERVICE WILL DETECT ALL COMPLIANCE VIOLATIONS; (b) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; (c) THE COMPLIANCE ENGINE WILL SATISFY YOUR SPECIFIC REGULATORY REQUIREMENTS. YOU ARE SOLELY RESPONSIBLE FOR ENSURING YOUR LLM USAGE COMPLIES WITH APPLICABLE LAWS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSTCHAIN AI SHALL NOT BE LIABLE FOR: (a) INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES; (b) LOSS OF PROFITS, DATA, OR BUSINESS; (c) DAMAGES EXCEEDING THE AMOUNT PAID BY YOU IN THE 3 MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS — IN SUCH CASES, LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.

You agree to indemnify and hold TrustChain AI harmless from claims, damages, and costs arising from: (a) your use of the Service in violation of these Terms; (b) data you process through the Service; (c) your violation of applicable laws.

We may suspend or terminate your account immediately if you: (a) breach these Terms; (b) engage in fraudulent activity; (c) fail to pay applicable fees. You may terminate your account at any time from Settings. Upon termination, your data will be retained per our Privacy Policy.

These Terms are governed by the laws of the State of California, USA. Any disputes shall be resolved in the courts of San Francisco County, California, unless otherwise required by applicable consumer protection laws.

We may update these Terms periodically. Material changes will be notified via email 14 days in advance. Continued use after the effective date constitutes acceptance.
